New Mexico has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), including subsequent amendments. Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.

Accident reporting - Motor carrier

NotificationThe driver of a vehicle involved in an accident must report the accident to the State Highway and Transportation Department if the accident results in:
  • Death
  • Injury or
  • Property damage $500 or more
Reporting Timeframe
  • Five days
