Kansas has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2018. Section 390.15 includes accident recordkeeping requirements.
Section 390.15 applies to vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or vehicles transporting hazardous materials requiring placarding.
Exception: Private motor carriers domiciled in Kansas operating vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 to 26,000 pounds are exempt from compliance with 390.15. This exemption does not apply to motor vehicles which are used in the transportation of hazardous materials and required to be placarded.

| Notification | The driver must notify local law enforcement if the accident results in:
Whenever the driver of a vehicle is physically incapable of giving an immediate notice of an accident as required, and there was another occupant in the vehicle at the time of the accident capable of doing so, the occupant must notify local law enforcement. |

Obtaining an accident report
| Procedure | A copy of an accident report may be obtained in person, or by sending a request in writing, accompanied by the required fee, to the State Highway Patrol. A copy of an accident report may be obtained online: https://www.kansas.gov/accident-reports/. |
