Idaho has adopted 390.15 of the Federal Motor Carrier Safety Regulations, as published and annually recompiled. Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to intrastate carriers operating commercial motor vehicles transporting property with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating greater than 26,000 pounds, and intrastate carriers transporting placardable quantities of hazardous material subject to the authority of the Idaho State Police.

Accident reporting - Motor carrier

NotificationThe driver must notify the local police, county sheriff, or state police if the accident results in:
  • Death,
  • Injury, or
  • Property damage ≥ $1,500.

Obtaining an accident report

ProcedureAn official accident report for any accident that results in more than $1,500 damage to any one vehicle or injury to any person should be obtained from the Idaho Transportation Department.
