Hawaii has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs) as they existed on May 31, 2018. Section 390.15 includes accident recordkeeping requirements.
Section 390.15 applies to interstate and intrastate operation of a vehicle with a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight of 10,001 pounds or more, whichever is greater, or a vehicle of any size transporting a placardable amount of hazardous materials.
Accident reporting - Motor vehicle
| Notification | The driver must report to police if the accident results in:
Any accident in which an unattended vehicle or property is struck must also be reported to the police. |
| Reporting Timeframe | Immediately (a written report must be submitted within 24 hrs.) |
Obtaining an accident report
| Procedure | In the State of Hawaii, all motor carrier accident investigation reports are confidential and are not released as public information. |
