Delaware has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), with future amendments. Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to a single vehicle or a vehicle in combination operated in intrastate commerce with a gross vehicle weight rating or gross vehicle weight over 26,000 pounds, and any size vehicle hauling hazardous materials requiring placards.

Accident reporting - Motor carrier

Notification Driver must report to law enforcement if the accident results in:
  • Fatality
  • Injury or
  • Property damage to an apparent extent of $2,000 or more
Reporting Timeframe Immediately

Obtaining an accident report

ProcedureMust send a written request and the required fee to the Department of Safety and Homeland Security, Division of State Police. The following information must be submitted with the request:
  • Date of accident
  • Location of accident
  • Names of all operators, owners, pedestrians or others involved with the accident
  • A stamped self-addressed envelope
Fee
  • $25.00 for personal injury or property damage accident report
  • $60.00 for a complete fatal accident investigation report
