Delaware has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), with future amendments. Section 390.15 includes accident recordkeeping requirements.
Section 390.15 applies to a single vehicle or a vehicle in combination operated in intrastate commerce with a gross vehicle weight rating or gross vehicle weight over 26,000 pounds, and any size vehicle hauling hazardous materials requiring placards.
Accident reporting - Motor carrier

- Property damage to an apparent extent of $2,000 or more

Obtaining an accident report
| Procedure | Must send a written request and the required fee to the Department of Safety and Homeland Security, Division of State Police. The following information must be submitted with the request: - Date of accident
- Location of accident
- Names of all operators, owners, pedestrians or others involved with the accident
- A stamped self-addressed envelope
