Colorado has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2025. Section 390.15 includes accident recordkeeping requirements.
Section 390.15 applies to a self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer’s gross vehicle weight rating or gross combination rating of at least 16,001 pounds. Section 390.15 also applies to a vehicle used on a public highway to transport a placardable amount of hazardous materials.
Accident reporting - Motor carrier
| Notification | The driver must report to local law enforcement if the accident results in: - Death
- Injury or
- Property damage
If additional information is needed, the Department of Revenue will send notice to the driver(s) of the vehicle(s) involved in the accident. |

Obtaining an accident report
| Procedure | A “Requestor Release and Affidavit of Intended Use” form (DR 2489) must be used to obtain a copy of an accident report. The form may be accessed via the Department of Revenue website: https://www.colorado.gov/pacific/dmv/forms-number-order |
