Arkansas has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), including all future amendments. Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to any self-propelled or towed motor vehicle used on a highway when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.

Accident reporting - Motor carrier

Notification A “Safety Responsibility” accident report (SR 1-21) must be submitted if the accident results in:
  • Death,
  • Injury, or
  • Total property damage to an apparent extent of $1,000 or more.

The Department of Arkansas State Police may require any driver of a vehicle involved in an accident that must be reported to file supplemental reports whenever the original report is insufficient in the opinion of the Department of Arkansas State Police and may require witnesses of an accident to render reports to the Department of Arkansas State Police.
Reporting Timeframe 30 days

Obtaining an accident report

Procedure A copy of an official motor vehicle crash report may be obtained by sending a request, with the required fee to the Arkansas State Police.
The request must include:
  • Driver(s) name(s),
  • Date of accident,
  • Highway number, and
  • County in which the accident occurred.

An “Arkansas State Police Crash Report Request” form may be accessed at: https://dps.arkansas.gov/law-enforcement/arkansas-state-police/services-programs/crash-records/
A report may also be obtained online at: https://crashreports.ark.org/.
Fee
  • $10.00 if the requester is involved in the crash
  • $25.00 if the requester is not involved in the crash
