Alaska has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), revised as of March 15, 2023. Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to a self-propelled or towed vehicle that has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 14,000 pounds or more, or is used to transport hazardous materials.

Accident reporting - Motor carrier

NotificationAn electronic or written report, using the “Crash Report” form (12-209), must be filed with the Department of Administration (and local police department if accident occurs in a municipality) when there is:
  • A fatality,
  • Bodily injury, or
  • Total property damage to an apparent extent of $2,000 or more.

Also, for all crashes over $501, a “Certificate of Insurance” form must be completed and mailed to DMV within 15 days to avoid suspension of the driver's license due to the mandatory insurance law.
The “Crash Report” (12-209) and “Certificate of Insurance” forms may be accessed at: http://dot.alaska.gov/stwdplng/hwysafety/driverreport/.
Reporting TimeframeReport must be filed within 10 days of the accident.
Report not required if investigated by law enforcement or if driver physically incapable of filing a report.

Obtaining an accident report

ProcedureA “Request for Crash Report” form (#440) may be used to obtain a report: http://doa.alaska.gov/dmv/forms/PDFS/440.PDF.
