Summary of differences between federal and state regulations
The federal minimum wage provisions are contained in the Fair Labor Standards Act (FLSA). Many states also have minimum wage laws. In cases where an employee is subject to both the state and federal minimum wage laws, the employee is entitled to the higher of the two minimum wages.
Effective January 1, 2028, the minimum wage for Virginia employees is $15.00 per hour.
Effective January 1, 2027, the minimum wage for Virginia employees is $13.75 per hour.
Effective January 1, 2026, the minimum wage for Virginia employees is $12.77 per hour.
Effective January 1, 2025, the minimum wage for Virginia employees is $12.41 per hour.
Effective January 1, 2023, the minimum wage for Virginia employees is $12 per hour.
State eliminates subminimum wage for disabled workers beginning in 2030
Following the signing of H.B. 1924 on April 12, 2023, the state has begun moving toward ending subminimum wages for disabled workers. Employers may continue to pay subminimum wage to disabled workers if they have been paying subminimum wages before July 1, 2023, under a special federal 14(c) certificate. However, beginning July 1, 2030, disabled workers will be considered employees for minimum wage purposes, and all employers must pay disabled workers at least the minimum wage regardless of whether they hold a 14(c)-certificate issued before July 1, 2023.
