OSHA does not have a comprehensive OSHA standard for the cannabis cultivation and production industry. However, many of the OSHA general industry standards may apply, as well as the General Duty Clause (Section 5(a)(1) of the Occupational Safety and Health Act of 1970, and codified at 29 U.S.C. 654(a)(1)). An OSHA Fatal Facts issue no. 20-2025, entitled, “Occupational Allergies and Asthma in the Cannabis Cultivation and Production Industry” lists four standards that may apply. These include: 29 CFR 1904, Recordkeeping and Reporting Occupational Injuries and Illnesses; 1910.132, Personal Protective Equipment; 1910.134, Respiratory Protection; and 1910.1200, Hazard Communication. OSHA state-plan states are required to have standards and enforcement programs that are at least as effective as federal OSHA’s but may have different or more stringent requirements.
