The Federal Motor Carrier Safety Regulations (FMCSRs) include provisions that require the holder of a commercial driver’s license (CDL) or commercial learner's permit (CLP) to notify their motor carrier if convicted of a motor vehicle violation or if their CDL or CLP has been suspended, revoked, or cancelled.

These regulations apply to a CDL holder, CLP holder, and motor carrier.

Key definitions
- Commercial driver’s license (CDL): A license issued to an individual by a state or other jurisdiction of domicile, in accordance with the standards contained in 49 CFR 383, to an individual which authorizes the individual to operate a class of a commercial motor vehicle.
- Commercial learner’s permit (CLP): A permit issued to an individual by a state or other jurisdiction of domicile, in accordance with the standards in 49 CFR 383, which, when carried with a valid driver’s license issued by the same state or jurisdiction, authorizes the individual to operate a class of a commercial motor vehicle when accompanied by a holder of a valid commercial driver’s license (CDL) for purposes of behind-the-wheel training. When issued to a CDL holder, a CLP serves as authorization for accompanied behind-the-wheel training in a CMV for which the holder’s current CDL is not valid.
Summary of requirements
Drivers must notify their employers of any motor vehicle violations within 30 days after they have been convicted.
Notification to the employer must be in writing and contain the following information:
- Driver’s full name;
- Driver’s license number;
- Date of conviction;
- The specific offense or violation and any suspension, revocation, or cancellation of driving privileges as a result of the conviction;
- Indication of whether the violation was in a CMV;
- Location of the offense; and
- Driver’s signature.
If the driver’s CDL or CLP is suspended, revoked, or cancelled, disqualifying the driver from operating a CMV, the employer must be notified before the end of the business day following the day the notice was received.
