Answer: Yes. The Occupational Safety and Health Administration (OSHA) 1926.300(b)(1) requires, “When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.”
Most concrete mixer motors are manufactured with a motor cover. Through normal use and wear and tear, the cover can become damaged or removed. In these cases, the cover needs to be repaired or replaced. Even when the mixer’s motor didn’t come with a cover, the company must protect workers under OSHA’s General Duty Clause from any hazard in the workplace that workers can be exposed to.
