When a motor cover cracks
Scenario: An established concrete company has been using the same mixers for about seven years. During a particularly busy summer season, one of the motor covers cracks, but remains in place. If it were the off-season, employees would have time to fix the cover. Since it’s not, and employees are already working overtime, the company has decided to keep this mixer operational to meet customer demand. Once construction season slows, a new guard will be ordered and installed.
Question: Does the motor cover need to be repaired sooner? What do you think?

When a motor cover cracks: Answer
Answer: Yes. The Occupational Safety and Health Administration (OSHA) 1926.300(b)(1) requires, “When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.”
Most concrete mixer motors are manufactured with a motor cover. Through normal use and wear and tear, the cover can become damaged or removed. In these cases, the cover needs to be repaired or replaced. Even when the mixer’s motor didn’t come with a cover, the company must protect workers under OSHA’s General Duty Clause from any hazard in the workplace that workers can be exposed to.
