- b. False. The Federal Motor Carrier Safety Administration’s (FMCSA) doesn’t require first-aid kits in CMVs. Such requirements, if they exist, are found at the state and local level. Some states have requirements for “specialty” vehicles such as school buses and refuse trucks, but typically not for all CMVs.
- d. The FMCSA has authority over fire extinguishers in CMVs, but has limited rules for inspecting them. Section 392.8 requires drivers to make sure fire extinguishers are “in place and ready for use” before driving. This is generally understood to be a daily pretrip inspection requirement. Under 393.95, extinguishers must be fully charged, securely mounted, and ready for use. If an extinguisher doesn’t work when called into use, it’s an FMCSA violation. There is no requirement to have vehicle-mounted extinguishers inspected by anyone on an annual basis. Some companies choose to include their CMV extinguishers in their OSHA inspection program, even though not required.
