Do you know when food transport is exempt from STHAF rules?

Are these scenarios exempt under the Sanitary Transportation of Human and Animal Food (STHAF) rules?

Scenario 1: A company that uses rail vehicles to transport food meant for intrastate only commerce.

Scenario 2: Food being transported by motor vehicle that requires temperature control through the U.S. from Canada and destined for Mexico.

Scenario 3: Food transported from China that is in a storage unit awaiting shipment to Brazil. Some of the food will be transported and distributed within the U.S. before it is exported.

Do you know when food transport is exempt from STHAF rules?: Answers

  1. No. The STHAF rule applies to food transported within the United States by motor or rail vehicle, whether or not the food is offered for or enters interstate commerce.
  2. Yes. The transportation of food that is transshipped through the United States to another country is exempt from the STHAF rule.
  3. No. The transportation of food that is imported for future export is only exempt from the rule if it is neither consumed nor distributed in the United States.
