Texas has adopted Sec. 390.15 of the Federal Regulations, which includes accident recordkeeping requirements.
Applicability
Sec. 390.15 applies to a vehicle or combination of vehicles with an actual gross weight or a gross weight rating in excess of 26,000 pounds when operating intrastate, and a vehicle of any size hauling hazardous materials requiring placarding.
Notification
The driver of a motor vehicle involved in an accident must immediately notify local law enforcement if the accident resulted in death, bodily injury, or damage to the vehicle resulting in the vehicle being unsafe to operate.
How to obtain accident reports
Procedure
A “Request for Copy of Peace Officer’s Crash Report” form (CR-91) may be used. It may be obtained via the Texas Department of Transportation website: https://www.txdot.gov/driver/safety/crash-reports.html.
An accident report is also available online: https://cris.dot.state.tx.us/public/Purchase/app/home.
Fee
$6.00 for each report; $8.00 for a certified copy of a report.
