Indiana has adopted Part 396 of the Federal Regulations.
Part 396 applies to for-hire carriers operating motor vehicles exclusively in intrastate commerce that have a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 10,001 pounds or more.
Part 396 applies to private carriers operating motor vehicles exclusively in intrastate commerce that have a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 26,001 pounds or more.
Part 396 applies to any size vehicle (for-hire or private) transporting a placardable amount of hazardous materials.
Exception — Private carriers of property operated only in intrastate commerce or any carriers of property operated only in intrastate commerce while employed in the construction industry are exempt from 396.11 and 396.13. These carriers must operate wholly in intrastate commerce to take advantage of these exemptions.
Exception — Vehicles operated by private carriers of property only in intrastate commerce, carrying a perishable product are exempt from 396.9 unless an imminent safety hazard exists. The exemption from 396.9 is not intended to include refrigerated vehicles loaded with perishables when the refrigeration unit is working.
Exception — The operator of a “covered farm vehicle” as defined in Sec. 390.5 is exempt from the vehicle inspection requirements in Part 396. This exception does not apply if transporting a placardable amount of hazardous materials.
