Michigan has adopted Part 395 of the Federal Regulations.
Part 395 applies to a vehicle or combination of vehicles, operating in intrastate commerce with a gross combination weight or gross combination weight rating of 26,001 pounds or more inclusive of a towed unit(s) with a gross vehicle weight rating or gross vehicle weight of more than 10,000 pounds, whichever is greater; a gross vehicle weight rating or gross vehicle weight of 26,001 pounds or more, whichever is greater; or of any size and used in the transportation of hazardous materials.
Exception — The rules in Part 395 do not apply to farm vehicle drivers as defined in Sec. 390.5.
Exception — A motor carrier operating entirely in intrastate commerce solely within Michigan shall not permit or require a driver of a commercial motor vehicle engaged in seasonal construction-related activities (regardless of the number of motor carriers using the driver's services) to drive for more than 12 hours or be on duty for more than 16 hours in any day or drive for any period after having been on duty for 70 hours in any seven consecutive days or having been on duty for 80 hours in any period of eight consecutive days.
Michigan has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
