Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment or payment within a specific time period.
South Carolina Code §41-10-50 requires that for involuntary termination the final paycheck is due within 48 hours of the time of separation or the next regular payday, but no more than 30 days from date of termination. There are no regulations for voluntary termination.
