Employers are not required by federal law to give former employees their final paycheck immediately. Some states, however, may require immediate payment or payment within a specific time period.
New Jersey Revised Statutes §34:11-4.2 and 4.3 require that for voluntary or involuntary termination the final paycheck is due on the next regular payday or 10 days from the end of the pay period.
