- The labels on the boxes show incompatible materials: Spontaneously combustible materials and Corrosive materials. See the Segregation Table in 177.848. No person may accept for transportation or transport by motor vehicle any materials that are “forbidden” in the regulations or hazardous materials not prepared in accordance with the regulations. See: 173.30 and 177.801.
- The hazmat items are missing the markings on the packages. See: 172.301.
- The box on top of the lettuce states “Fragile Handle with Care.” It does not seem to be adequately secured to keep from shifting while in transit. See: 393.106.
- The lettuce and the “Keep Frozen” box seem to be at odds with each other. In order to keep the top item frozen, the lettuce would result in spoilage, and if the lettuce is kept at its appropriate temperature, the frozen item would thaw.
- If you guessed that the hazmat items may not be shipped next to food items, you guessed incorrectly. Section 177.841 only applies to items labeled or placarded as poison or poison inhalation hazard, neither of which includes the corrosive or spontaneously combustible placard on the items in the photo.
